Since September of 2024, North Carolina CBD and Vape shops have been worried about the looming police seizures and raids sweeping across the state. Starting in the Charlotte and Asheville areas, police recently ramped up raids on CBD and vape shops across the state. Alamance and Orange counties have been recent targets, and law enforcement is not stopping there.  Not only did this affect the shops that were rumored to be breaking the rules, but this also affected honest businesses following the current laws.

The laws have been unclear, leaving room for these seizures and investigations on even the innocent shops. The most recent Senate Bill 265 is going to make things more definitive, for both shops and law enforcement. For example, THC is still illegal in NC, however, the sale of THCA is legal as long as the THC level is under the federal legal amount of .3% THC. Once heated, THCA Converts to THC, as long as it’s sold as THCA it’s legal. I will be going into more detail on this later.

Why COAs Are Important

Businesses use Certificates of Analysis to confirm that the flower they are purchasing to sell is within legal confines. There will be more to discuss in more detail throughout this blog. Unfortunately, not all CBD and Vape shops were making sure they had legal products and necessary COAs. Some businesses weren’t being strict about checking the age of their customers and were selling to minors. Thanks to these businesses not following the rules, this gave room for law enforcement to dig deeper.  Sadly shops that have been making sure they are doing everything in compliance with the law are also under scrutiny. This process is putting honest business owners under a lot of stress and debt to clear their names, bringing this beyond the point of harassment.

The Rec Dispensary alone saw over half its income disappear. Now, both shop owners and customers are left in a fog of uncertainty. These aggressive crackdowns highlight just how urgently North Carolina needs clearer regulations and better education for law enforcement because when the rules aren’t clear, everyone loses.
