Is Hemp illegal in NC?

In July 2022, the NC General Assembly nearly allowed the Pilot Program to expire without an ongoing law to support the legal hemp allowed in the US Farm Bill.

The sale of cannabidiol (CBD) is not currently banned by the US government. However, the legal status of CBD is complex and can vary depending on the specific product and how it is marketed. So, when the questions “Is Hemp illegal in NC?” comes up, we have an answer. But the status appears to be fluid in other States.

In North Carolina, the State Legislature took action in the eleventh hour to preserve the Hemp products in the State. The pilot hemp program was due to expire on July 1, 2022. Thankfully, the replacement legislation protected the legality of hemp before the expiration.

In 2018, the US Congress passed the Agriculture Improvement Act of 2018, also known as the Farm Bill, which legalized hemp and hemp-derived products, including CBD. However, the US Food and Drug Administration (FDA) has not yet fully established regulations for CBD products, and has issued warning letters to companies that make unproven or misleading claims about the health benefits of CBD.

In June 2018, the FDA approved the first drug containing CBD, Epidiolex, to treat seizures associated with two rare and severe forms of epilepsy, Lennox-Gastaut syndrome and Dravet syndrome. The FDA also stated that it would continue to evaluate the safety and efficacy of CBD products, and that it would take action against companies that violate federal law.

As of now, it is unlikely that the US government will ban the sale of CBD, as it is now a legal product derived from hemp and it’s also in an FDA approved drug. However, the FDA will be closely monitoring the market and may take action against companies that violate federal laws, such as making false claims about the health benefits of CBD.
