Is it Legal to Smoke Hemp Flower? What about flower with Delta 8 THC? What about THCa flower?
Too many people don’t understand what is legal with hemp and what is not.
We do not want anyone getting into a bad situation because of a misinterpretation of statutes.
We hope to dispel some of the rumors and hearsay and present the facts – all in a fun way.
One issue is what do you do when a cop stops you and you have LEGAL weed (aka Cannabis) that is under 0.3% of Delta 9 THC?
Now, this all depends on your individual State and in some cases the municipality too with regard to what you can and cannot do. Generally, since Hemp is legal for commerce and transportation, having legal cannabis from the hemp plant is permitted when you are in a car.
What is typically NOT permitted is transporting potted plants (there are special circumstances for transportation in the various States’ statutes).
For example, it is legal to transport hemp products from a dispensary or store to your home in North Carolina. Hemp products are legal in North Carolina as long as they contain less than 0.3% THC. The North Carolina General Assembly passed House Bill 519 in 2017, which legalized the cultivation and sale of hemp products in the state. The law went into effect on July 1, 2017.
